Leftist Lexicon Word of the Week

Leftists are hoping for a major Christmas present thanks to their new Santa Claus, Robert Mueller in the form of an obstruction of justice indictment against President Donald Trump. When you consider the multiple problems with the Mueller investigation make it more useless than a corner sofa set in a round building, the Left might be getting a piece of coal in their stockings.

Since the “Trump colluded with Russia” line has run its course (and uncovered actual collusion between Russia and Hillary Clinton/DNC), the Left is pivoting to obstruction of justice using President Trump’s firing of James Comey as proof he was trying to delay or disrupt the investigation into his ties with Russia. Whether these charges have any legal weight to them is questionable, but what isn’t questionable is the Left may not have that great a grasp on what obstruction of justice actually is.

Fortunately, I do, or this would be a really short blog post.

What the Left thinks it means – preventing an investigation into a crime, such as Donald Trump has committed

What it really means – hindering an investigation into a crime, not unlike what the Clintons/DNC have done

First off, obstruction of justice isn’t a partisan matter. Neither major party has a monopoly of criminal activity and attempts to cover it up through various means, such as misdirection, lying to investigators, or generally being a smug assbag with good lawyers. Having said that, I have seen more attempts to obstruct justice coming from the Left than I have from the Right in recent years.

But before we jump too much further into the matter, we need to understand what the obstruction of justice charge entails. And that requires a bit more than a sassy definition from a justly underpaid blogger.

The Legal Information Institute states obstruction of justice:

is defined in the omnibus clause of 18 U.S.C. § 1503, which provides that “whoever . . . . corruptly or by threats or force, or by any threatening letter or communication, influences, obstructs, or impedes, or endeavors to influence, obstruct, or impede, the due administration of justice, shall be (guilty of an offense).” Persons are charged under this statute based on allegations that a defendant intended to interfere with an official proceeding, by doing things such as destroying evidence, or interfering with the duties of jurors or court officers.

A person obstructs justice when they have a specific intent to obstruct or interfere with a judicial proceeding. For a person to be convicted of obstructing justice, they must not only have the specific intent to obstruct the proceeding, but the person must know (1) that a proceeding was actually pending at the time; and (2) there must be a nexus between the defendant’s endeavor to obstruct justice and the proceeding, and the defendant must have knowledge of this nexus.

  • 1503 applies only to federal judicial proceedings. Under § 1505, however, a defendant can be convicted of obstruction of justice by obstructing a pending proceeding before Congress or a federal agency. A pending proceeding could include an informal investigation by an executive agency.

    To put it another way, obstruction requires intent, knowledge, and a clear connection between the action to obstruct and the investigation or judicial proceeding.Here’s where the Left gets it wrong with Trump: his actions don’t meet the legal threshold, no matter what their anti-Trump hysteria tells them. FBI Director James Comey was not all that effective, as evidenced by his mishandling of the case against Hillary Clinton. It was so bad even Democrats were calling for him to resign. Then…Trump happened. Overnight, Comey went from Joe Biden level incompetence to Solomon reincarnated, in spite of the fact he didn’t really lose his incompetence. Trump fired Comey, which he had every right to do because, well, he’s the freaking President, and the Left came up with the obstruction of justice story. After all, the only reason Trump got rid of Comey was because he was closing in on proof of Russia’s collusion with the Trump campaign right?

    Oooooh, sor-ray. Seems Comey was fired for the aforementioned incompetence, and the investigation into the alleged collusion continued on unabated. There is even some question as to whether Trump knew he was under investigation based on what Comey has said. So, let’s see…the President had the power to fire Comey and would have known the firing would not have stopped the investigation…and it’s up in the air whether Trump knew he was being investigated…and the investigation didn’t stop as a result of the firing. Kinda puts a damper on the Obstruction-A-Palooza the Left has been dreaming of.

    Collusion is off the table, and now obstruction of justice is off the table, or should be under normal circumstances. Ah, but the Left isn’t on speaking terms with normal, so they’ll continue to make the case for obstruction of justice in spite of the facts. And remember, kids, the Left is fact-based (just ask them). But to those of us outside of the Leftist bubble, it’s hard to see where there is a legal case to be made.

    But there is another element: the political. Even if the legal case is on shakier ground than a sinkhole on the San Andreas Fault, the fact the allegations continue becomes a political cudgel for the Left to use whenever mentioning President Trump. And since the Left preys upon the ignorant, it will continue to pump out stories to make it seem like Trump is hiding something. All it takes is a momentary lapse of common sense to believe it.

    And all it takes to burst the Leftist bubble is to point out the facts. Unfortunately for the Left, I’m kinda partial to facts, which makes me a porcupine. Hey, I’ve been called worse!

Attonerys General

Last week the Attorneys General of 20 states sent a letter of the Deputy Attorney General of the United States. They called the firing of FBI Director James Comey by President Trump a violation of the public trust. But when reading the letter that was penned by Maura Healey, the Attorney General of The Commonwealth of Massachusetts, we see a lot of problems with it.

In the letter, Ms Healey states that the firing of Mr Comey is a violation of the public trust. As a member of that public I do not consider the action to be any kind of violation. Mr Comey should have been fired on January 20th. And as the FBI Director his term of employment is subject to the will of the President.

In the same paragraph Ms Healey refers to our system of government as a democratic system. Ms Healey needs to attend a non Liberal civics 101 class and learn that our system is a constitutional republic.

Also in the 2nd paragraph opens with the following sentence, and I quote:

The residents of our states and the American people deserve a through investigation that makes clear the extent of Russian meddling, any collusion by Trump campaign officials, and any cover-up.

So Ms Healey clearly states there was, without a doubt, Russian meddling in the 2016 Presidential Elections. Where is your proof Ms Healey? Your letter doesn’t state that Russian meddling is a possibility, it states it as a fact. As caught red handed in the cookie jar.

Perhaps Ms Healey also needs to take course in American law. Where one is innocent until proven guilty. But to her, and the other Liberals like her, Donald Trump is guilty without a trial and without evidence since there isn’t a single shred of it.

It is worth noting that 19 of the 20 Attorneys General who signed this letter are all registered Democrats. All 19 of those are from liberal states. Only 1 is not a Democrat, but I have yet to find out what that one is. And I am ashamed to say that my own State Attorney General is among those who signed this ridiculous document.

Ya’ll Don’t Comey Back Now, Ya Hear

What a difference a week makes!

We return to the thrilling days of yesterweek and to the story of now-former FBI Director James Comey. After Congressional testimony where Comey looked more out-of-sorts than Gary Busey on a day ending in y, Democrats were up in arms. Comey was incompetent and was responsible for Hillary Clinton losing the 2016 election! (Little did we know the FBI had so much control over Hillary’s lack of campaigning in key states!) Comey was compromised and he needed to go, like, yesterday!

Fast forward to yesterday afternoon. President Donald Trump fired Comey after another brutal day of Congressional testimony after it was clear he was more of a liability than an asset. Who knew Trump had a history of firing people? And Democrats reacted by…claiming Trump fired Comey because he was getting too close to the truth with a probe into whether Trump colluded with Russia to help him win the 2016 election.

If you ever wonder why I stopped being a Leftist, this is why. Keeping up with the day-to- day narratives requires either flexible morals, the attention span of a mayfly with ADD, or a flow chart on a dry erase board. One week, Comey is horrible. The next, he’s a valiant warrior for truth, justice, and the People for the American Way (a wholly owned subsidiary of our good friend, Uncle George Soros.) Even Leftists are having a hard time keeping up with the narrative, if Stephen Colbert’s recent audience reaction to news of Comey’s firing is any indication. (Spoiler Alert: Colbert didn’t expect cheering and had to tell his audience how to feel about the news. Hmmm…maybe Colbert has more experience being a news anchor than we thought…)

There is an easy way to cut through the crap, though: stay consistent to your beliefs. Granted, that’s hard for the Left to do, but for the rest of us, it’s not that hard. I’m on record as saying I felt Comey wasn’t doing a good job under the spotlight, and I still feel that way. In fact, I still think he may be angling for something else just like Joe Wilson, husband of CIA Barbie Valerie Plame, was. We’ll see what comes of Comey now that he’s out of a job. If my hunch is correct, he will show his true colors and give the Trump Administration more fits simply by existing, and the Democrats and Leftists will eat it up.

Just a word of warning, Mr. Comey. Remember the last time you saw either Wilson or Plame? Neither do most of us. That’s the fate that awaits you if you try to curry favor with the Left after being fired. They will chew you up and spit you out faster than feces flavored chewing gum. These fairweather fiends will never let you into their inner circles no matter what you do for them. You are a means to their ends, and that’s all you’ll ever be.

But give the Left time. They’ll pull another Jeckyl and Hyde act soon enough.

The Strange Case of James Comey (or With Friends Like These…)

Michael Savage likes to say liberalism is a mental disorder. After seeing the Left turn on FBI Director James Comey with all the stability of Sybil on PCP, he might be onto something. Or on something, whatever the case may be.

The Left has a love/hate relationship with Comey. Sometimes, like when he declined to pursue charges against Hillary Clinton over her private email server, the Left loved him. When Comey did something they didn’t like, like announcing the FBI would be reopening the case against Clinton, the Left loved to hate him. Comey became the Left’s favorite piñata when it suited them, but he’s gotten back into their good graces recently by rejecting Donald Trump’s claims former President Barack Obama wiretapped Trump Tower during the campaign. Now that he’s anti-Trump, the Left loves Comey again.

Maybe I was a bit off with the Sybil reference. Sybil was far more well-adjusted.

Some conservatives were in a similar situation as the Left in that their opinions on Comey depended on what he did for them politically. However, a good chunk of the Right saw Comey as an inept bumbler whose decision-making skills made Charlie Sheen look like Solomon. When the FBI Director tells you he can’t prosecute a Presidential candidate because she’s more famous or powerful than you or me, that’s the sign he can’t hack the job he has.

Now that he’s being more of a pawn than a prosecutor, Comey’s going to get more attention from both sides of the aisle, and not for a good reason. The Left will use him as a meat shield to deflect even the most credible of concerns over whether President Obama tapped the lines at Trump Tower. The Right will use him as a scapegoat for enabling the Left.

And I will use him as a target for mockery.

Comey appears to have gone to the Leona Helmsley School of Law, given how he treated Hillary with more kid gloves than a Minnesota daycare center in January. The fact he even raised the “she’s Hillary Clinton” defense is an indication he has been compromised to the point of ineffectiveness. He should have been kicked to the curb back in July 2016, but as we’ve seen with the Obama Administration, incompetence was a resume enhancer.

I get the feeling Comey is trying to play to whichever crowd will lavish him with praise. If he gets invited to parties by parroting the Left, he will be further to the Left than David Brock. If that party scene dries up, he’ll come back to the Right and say and do whatever they want him to do. In other words, James Comey is the FBI equivalent of John McCain.

But eventually neither side will want to be seen with him, and then he’ll be left trying to reconcile the multiple positions he will have taken to that point. And he will fail. The problem with trying to please everyone is you wind up pleasing no one, not even yourself. Comey seems to be in that phase right now, but his value is diminishing. If you stand with truth and integrity, you will gain friends and enemies, but both will be the right ones.
